Agreement to These Terms

These Terms of Service ("Terms") govern your use of the website at emerycustombuilds.com (the "Site"), operated by Underhill Enterprises LLC, doing business as Emery Custom Builds ("Emery Custom Builds," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

These Terms apply only to your use of the Site and the free resources we provide through it. They do not govern any custom van or cargo trailer build project. Build projects are covered by a separate written contract signed by both parties.

Who May Use the Site

You must be at least 18 years old to use the Site or submit any form on it. By using the Site, you represent that you meet this requirement and that any information you provide is accurate.

Use of the Site

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms
  • Attempt to gain unauthorized access to the Site, its servers, or any related systems
  • Interfere with or disrupt the Site, including by introducing viruses or malicious code
  • Scrape, harvest, or collect information from the Site using automated means without our written permission
  • Submit false, misleading, or fraudulent information through any form on the Site
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity

Intellectual Property

All content on the Site — including text, articles, photos, videos, graphics, logos, and design — is owned by Emery Custom Builds or its licensors and is protected by U.S. copyright and trademark law. You may view and share links to our content for personal, non-commercial use. You may not copy, reproduce, republish, or redistribute our content for commercial purposes without our prior written permission.

"Emery Custom Builds" and the Emery Custom Builds logo are trademarks of Underhill Enterprises LLC. Nothing on the Site grants you any license to use our trademarks.

Quote Requests and Inquiries

Any price ranges, budget figures, or build examples shown on the Site are for informational purposes only. Submitting a quote request, contact form, or email does not create a contract or commit either party to a build. A build project only begins after we agree on a scope, you sign our written contract, and you make the required deposit.

Free Resources and Educational Content

Our Budget Guide, blog posts, comparison pages, and other educational content are provided for general informational purposes only. They are not professional advice for your specific vehicle, project, or situation. Vehicles, components, and regulations change. Always verify specs with manufacturers, qualified technicians, or licensed professionals before making purchase, build, or safety decisions.

Third-Party Links

The Site may link to third-party websites, products, or services that we do not own or control. We provide these links for convenience and do not endorse or assume responsibility for the content, policies, or practices of any third party. Limitation of Liability

To the fullest extent permitted by law, Emery Custom Builds, Underhill Enterprises LLC, and their owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Site or any content, products, or services referenced on it — even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to the Site is limited to one hundred U.S. dollars ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of this section may not apply to you.

Indemnification

You agree to indemnify and hold harmless Emery Custom Builds, Underhill Enterprises LLC, and their owners, employees, and contractors from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in San Diego County, California, and you consent to the personal jurisdiction of those courts.

We may update these Terms from time to time. When we do, we'll update the date at the top of this page. Your continued use of the Site after changes are posted means you accept the updated Terms.

Severability

If any part of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
